Enjoy town charm and country serenity in the prime location conveniently located near Newton, Andover, Sparta, and other Sussex County, northwest, NJ locations, including the upcoming Andover NJ Transit rail station. We are right off Route 206 and close to many amenity locations: 7 mins to Newton town hall & shopping center, Starbucks. 13 mins from Route 80, 15 mins to Lake Mohawk, 8 mins to Wild West City, Perona Farms & other wedding venues.

We offer high-speed Wi-Fi, Amazon Fire Stick, and smart TV apps, including Amazon Prime, Netflix, and other streaming services. We also provide a variety of board games, card games, puzzles, and outdoor games for your enjoyment.

Property Area:

The backyard features a fire pit with seating and memorable views, perfect for day and night outdoor entertainment. We also have a gas grill, a log grill with wood log seats, folding chairs, and outdoor game activities for your cooking and entertainment needs. The area offers a unique view of the changing seasons and abundant scenery around the property. Please be respectful of other guests, visiting family, or friends in the area. No loud noises or parties are allowed. Please note that we have a Ring doorbell camera and one exterior camera facing the driveway. There are no indoor cameras.

Our home is very close and central to other numerous year-round, four-season Touristic/recreational locations and amenities in the Tri-state area such as trailing, hiking, river tubing, fishing, canoeing, kayaking, zip-lining, archery, paintball, zoo/museum visits, snow tubing, skiing, sledding, bird watching, shopping centers, restaurants, etc., being only 5 mins to 60 mins away depending on location:

Newton, NJ, with its country center and shopping areas including Starbucks and Panera Bread, is just 12 minutes away. Sparta, NJ, and the beautiful Lake Mohawk are 12 minutes away. We are 15 minutes from Route 80 and 10 minutes from Perona Farms and other wedding venues. Skylands Stadium about 25 minutes away. Slam Dunk Museum, approximately 20 minutes away. The Newton Theatre is 10 minutes away. Kittatinny Valley State Park, 20 minutes away. This park offers a range of outdoor activities including hiking, biking, and bird watching, and is known for its diverse ecosystems and scenic views.

Excludes: garages, sheds on property, neighboring houses, and their specified areas.


Signs mark the areas of our property, and we advise you to please stay within the property area and be courteous with any neighbor and anyone working or also using the property.

IMPORTANT NOTICE FOR GUESTS:


If you're traveling with a larger group, we can accommodate you by opening additional units in the apartment. The Studio Room (https://www.tristatetravels.co...) can be connected to the First Floor 2br Unit, giving you an extra private space. If you need even more room, we can also make the Second Floor 3br available (https://www.tristatetravels.co...), providing even more accommodation options. Just let us know in advance, and we’ll be happy to arrange everything for you.

NO PARTIES OR LARGE GROUPS ALLOWED:


Parties, unauthorized guests, and extreme noises inside/outside of our houses are STRICTLY PROHIBITED. Unauthorized and unapproved guests will be considered trespassers and will be charged with a $2000 violation fee and will be reported to the police. Exterior camera video footage will be released and made available to the authorities AND public as evidence if noise, unauthorized guests, and/or a party takes place.

GROUP SIZE AND EXTRA GUEST FEE:


Please keep in mind that groups larger than 2 guests will include an extra guest fee of $35/guest per night after 2 guests in the total booking amount. Please be honest with group size, and number of guests as we have exterior property cameras (outside of the house) to protect and surveillance property.

PET FEE AND SERVICE DOGS:


We are one of the few stay locations that accepts house trained pets. There is a 3 pet maximum allowance and it is $30/per pet, per night fee. For Service dogs please be prepared to show proof of your certification to avoid the pet fee. Therapy dogs are not the same as Federal ADA recognized service dogs. Therapy dogs are still subject to approval and fee payment. Thank you.

PET RULES & VIOLATION FEES

For safety and security purposes, unleashed and loose dogs on the property are strictly prohibited due to having neighbors around and our properties not being fully fenced. Guests that do not comply risk their reservations being cancelled with no refund and will be charged a violation fee per the listing agreement.

FIRE PIT USAGE AND FIRE CONTROL:


There is an abundance of sticks, branches and small logs that can be used for firewood for the fire pit/bonfire, or for the fireplace inside the home but it is preferable guests bring their own firewood in case our firewood might not be usable/available.

Please be cautious when using any flame starter, and using the fire pit, as well as the fireplace. Please leave all fire turned off by wetting completely with water and making sure before leaving.

POWER OUTAGE DISCLAIMER:


Power outages unfortunately are out of our control. No refunds or reimbursements of any kind will be issued for any guest that experiences a power outage.

DAMAGE DEPOSIT:


A $250 damage deposit is required via Truvi (secure guest verification platform). You are required to complete guest verification, which will be sent by Truvi. This is a temporary authorization only (not a charge) and is released after your stay if no damages occur.

The only amount charged is a small $5 non-refundable processing fee, which is a 2% fixed handling fee of the $250 damage deposit.

RIVER AND ISLAND ACCESS DISCLAIMER:

Access and usage of our river and island river frontages is at your full discretion, and at your own risk. By booking this property, you are accepting all our terms and conditions and hold owners and any agents, and the properties harmless of any and all risks, liabilities and claims.

LENGTH OF STAY BOOKING DISCLAIMER:


By booking this property, you acknowledge and agree to the following terms:

- Your stay is strictly for transient purposes only, and there is no intention to establish a tenant-landlord relationship.

- You confirm that you have a permanent private residence elsewhere.

- This is an owner-guest agreement, not a rental lease.

- For legal and safety reasons, we do not accept long term reservations of more than 29 days. Bookings will be allowed and paid for in 29 days intervals for renewals.

- Guests staying beyond the agreed reservation period without written permission may be reported to local authorities and charged legal fees for removal.

Your booking serves as acknowledgment and acceptance of these terms.

CANCELLATION/DATES ALTERATION POLICY:


*We adhere to our strict cancellation policies. Requests for any alteration/changes of booking dates will only be accepted if it is within 13 days of the initial booking date. If alteration of dates is 14 days or more, then the guest MUST cancel reservation and adhere to cancelation policies. No exceptions or alternatives accepted.*

We require a $250 damage deposit through Truvi. This is processed as a temporary authorization (not an actual charge) and will only be charged if damages occur during your stay. If no damages are reported, the authorization is released automatically.

For our return guests: You do not need to verify with Truvi again. Simply log in to your existing Truvi account to submit your security deposit.

Short-Term Rental Agreement

This Short-Term Rental Agreement "Agreement" s made effective as of the day of your check-in, between Tri-State Travels, hereinafter referred to as the "Host," and the Guest.

Property Information:

Duration of Stay is determined by the details provided in the booking reservation.

Total Rental Fee is determined by the details provided in the booking reservation.

Terms and Conditions:

Rental Period: The Host agrees to rent the property to the Guest for the duration specified above.

Rental Fee: The Guest agrees to pay the total rental fee in full before or upon arrival, as specified above.

Security Deposit: The Guest agrees to undergo through our system called SuperHog for guest verification and will have to choose a damage protection plan before arrival. A non-refundable $75 for a damage waiver or a refundable $750 security deposit that will be refunded within 7 days after the check-out date, provided no damages are incurred to the property. You will also be responsible for the $20 fee for guest verification and credit card fees.

Arrival Time: Check in is 4:00 pm | DEPARTURE time is 11:00 am: If the home is ready before 4:00 pm, you may be allowed to check in early. You must call ahead to make sure the home is ready. Do not enter your rental early without permission because we need ample time to prepare the home for the next rental. Early check-in requests will be charged at $10/hr and late check-outs are not permitted unless stated by the Host and will be charged at a rate of $10/hr for each hour past 11am EST. Additional penalties may include, without limitation, additional daily or nightly rental fees and/or loss of revenue incurred by Agent due to the Rental Property not being available for the next group of the Guest. We do ask that if you plan to leave prior to your scheduled departure date, that you notify us by phone at or by e-mail at [email protected].

No Smoking Unit: Any kind of smoking inside the property IS STRICTLY FORBIDDEN. The Guest must also comply with any and all smoking restrictions in or around the Common Areas or Common Facilities. Evidence of smoking in or near the Rental will be subject to a $300 fine confirmed by our property smoke detection devices and cleaner managers.

Pets: Pets are allowed on the property and the Guest should be responsible for cleaning up after them, including any waste or droppings. The Guest also agrees to pay a $35 fee for every pet per night.

Use Restrictions: Property is not to be used for parties in or around the rental property, or in any common areas or facilities, or for gatherings beyond the registered number of guests. Rental of this property is limited to use by family groups. Primary Tenant must be at least 18 years old. Agent may require proof of the Guest’s age as demonstrated by a valid driver’s license, passport or other government-issued photo identification. If Host discovers that the Guest fails to meet this minimum age requirement, Host may immediately evict the Guest its group and all payments made by any Guest will be immediately forfeited. The person(s) signing the contract must be present during the rental period.

Excessive Noise: The Rental Property is located in a quiet residential neighborhood. Quiet time is from 10:00 pm until 8:00 am, or as may otherwise be required by the rules of the homeowner association (if any). The Guest agree not to undertake any activities that interfere with their neighbors' right to quiet enjoyment of their property. The Guest agree to fully comply with local noise regulations and to use common sense in keeping noise volume low after dark. Any enforcement actions by local law enforcement and/or homeowners association are at the Guest’s sole risk and expense and may result in additional charges or immediate eviction without refund of any deposits or rents.

ARRIVAL CONDITION: The home is inspected for cleanliness before your arrival. Please report anything that is not in acceptable condition within one hour of your arrival. Anything not reported in that time frame will be deemed acceptable.

Cancellation Policy: Any cancellation made by the Guest must be communicated to the Host. Cancellations made by the guest will not be refunded.

Number of Occupants: The Guest agrees that the number of occupants shall not exceed to the recommended people unless otherwise agreed upon by the Host and they will have to pay an additional $35 per person after 4 guests per night.

Maintenance and Care: The Guest agrees to maintain the property in a clean and orderly manner and to promptly report any damages or issues to the Host. Additionally, the Guest agrees to allow the Host or designated personnel access to the property for routine maintenance checks or urgent repairs, as necessary, to ensure the continued safety and functionality of the property. The Guest also agrees to follow the check-in and check-out instructions provided in the Digital Guidebook before check-in. We strive to ensure that all facilities are in good repair and everything is in working order; however, there may be occasions when an amenity is unavailable, out of order, or breaks down during occupancy. We will do our best to make repairs or replacements, but if neither is reasonably possible due to time or availability of parts or service, we cannot guarantee these items and will not issue refunds based on malfunctions or circumstances beyond our control.

HOLIDAY/PARTY DECORATIONS: Guests may decorate for special occasions at their own expense, but must remove and dispose of these decorations prior to departure. Christmas trees may not be left behind as the trash company will not pick them up. There will be a $50 fee for the disposal of such items left by guests.

LOCKED CLOSETS: Owners have locked closets for their personal possessions and extras for the rental. These closets are private and are not to be opened by The Guest or guests under any circumstances.

PARKING: The Rental Property may be subject to parking rules, regulations or policies as adopted and/or enforced by local government agencies or the homeowner’s association (if any). Tenant is expected to be aware of, and fully comply with, such parking rules, regulations or policies. Tenant is advised not to park any trailers at or near the Rental Property without Agent’s prior written permission. Neither the Agent nor the Owner of the rental property shall assume any liability or responsibility for any damage or costs incurred by any tenant as the result of any vehicle or trailer being parked at or near the rental property or being towed.

RATE CHANGES: Until a reservation is accepted and advance deposit is received to reserve a rental period, rates are subject to change without notice.


FALSIFIED RESERVATIONS: Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check-in.

STORM POLICY/ROAD CONDITIONS: No refunds will be given for storms. If your vacation is during the winter months, please come prepared to drive in snow and/or ice to reach your rental property. We do not refund due to road conditions.

WINTER CONDITIONS: The Guest are notified that this home is in a mountain location where winter conditions may apply. Walkways, driveways, sidewalks, stairs, etc… may be slippery due to ice and snow. These areas may be slippery even when they do not appear to be. It is advised that caution be used. Please step carefully on all outdoor surfaces. It is further advised that shoes be removed upon entering the home as wet or icy soles can cause slippery conditions on tile or wood floors inside the home.

*If applicable to the home* HOT TUB: No Children under the age of 12 are permitted in the hot tub without direct adult supervision. PLEASE SHOWER before using the hot tub. Excess body oils and lotions can cause the water to become cloudy, foamy, and/or discolored and decrease the filter efficiency. If hot tub is left discolored due to excessive use without showering, a fee of $100 will be charged to drain and refill. When using the hot tub, remember that there are certain health risks associated with using hot tubs. Use at your own risk. DO NOT press more than one function button at a time. This can affect the programming and cause the tub to discontinue heating and/or filtering. If maintenance is called to the home for user error, a $25 fee ($50 after hours) will be charged to the rental guest. This hot tub is drained, refilled and chemicals replenished on a regular basis. Hot tub covers are for insulation purposes and are not designed to support a person or persons. Do not stand or climb on the hot tub cover.

IDENTIFICATION: Owners/Managers are not responsible for any accidents, injuries or illness that occur while on the premises or its facilities unless such damage is the legal result of negligence or willful misconduct by the owner/manager. Owners/Managers are not responsible for the loss of personal belongings or valuables of the renter or their guests. By accepting this reservation, it is agreed that all renters/guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise. Renter shall indemnify and hold harmless the property owner or representatives of the property owner from all damages, injuries, claims, costs and expenses related to acts, events or omissions occurring in, on or about the property, or arising out of or in any way related to renter's use or occupancy of the property, renter's breach of any term of this Lease, or any work, activity or thing done, permitted or suffered by renter in, on or about the property.

NO ILLEGAL ACTS: Renter will comply with all statutes, ordinances, and requirements of all municipal, state and federal authorities and all HOA rules and regulations regarding the use of the property. The rental property shall be treated with respect and consideration. Please be aware that some neighbors to this home are renters and some are permanent residents. We ask that the peace and privacy of any of the neighbors to this home be respected at all times. Any violations of the above stated policy could result in eviction from the premises without notice and without refund of any deposits or rents. Any evidence of illegal activity will result in a minimum $300 fine.

WAIVER: Failure of Owner/Manager to enforce any provision of this agreement will not be deemed a waiver.

LEGAL: This Agreement shall be governed by and interpreted in accordance with the laws of the State of New Jersey. In any action or proceeding involving a dispute between owner and renter arising from this agreement, the prevailing party will be entitled to reasonable attorney fees and costs incurred.

CREDIT CARD: Any Tenant or intended Tenant who provides any credit card information to Vacation Rentals Park City, is doing so as a guarantee of payment of all or any portion of the Rental Fees and each such Tenant accepts all terms of this Agreement and accepts complete liability for the payment of any Rental Fees (including, without limitation, any costs, fees, expenses, charges or penalties related to the rental, occupancy and/or use of the Rental Property as set forth in this Agreement), as well as any

damage (not covered under the accidental damage policy) during any Tenant’s occupancy and use of the Rental Property. Each Tenant providing his or her credit card understands that these Rental Fees (excluding eCheck payments) will be charged to their credit card and hereby authorizes Agent to charge their credit card for payment of any such Rental Fees.

ENTRY, INSPECTION or EVICTION: Owner/Manager will have the right to enter the premises (a) in case of an emergency, (b) to make necessary or agreed repairs, alterations, improvements, supply necessary or agreed services, show the premises to prospective or actual buyers, The Guest, workers or contractors, (c) when renter has abandoned or left the premises or (d) when eviction is necessary due to breach of contract.

In the case of (b), entry may only be made during normal business hours and with prior notice to the renter.

In the case of (d), ALL the Guest and guests of the Guest must vacate the rental property within 60 minutes of the agent’s arrival to notify of eviction. If tenant or guests are present when agent arrives, up to 60 minutes will be allotted to immediately remove all personal property and exit the rental property. If tenant or guests are not present or personal property is not removed within 60 minutes, the agent will photograph, inventory and store said property. Charges in excess of the eviction fee may apply if items are required to be removed by the agent. The primary tenant must claim any stored personal property within 30 days. If not claimed, the personal property will be sold or donated.

ENTIRE AGREEMENT: The foregoing constitutes the entire agreement between the parties and may be modified only in writing and signed by all parties. Each section, subsection or paragraph of this Agreement shall be deemed severable. If for any reason any portion of this Agreement is unenforceable, that portion shall not affect the applicability or validity of any other portion of this Agreement. This agreement and any modifications, including photocopies or facsimiles, may be signed in one or more counterparts, each of which will be deemed an original and all of which taken together will constitute one and the same instrument. If there is more than one renter, all renters are jointly and severally liable under this rental agreement.

Liability: The Host shall not be liable for any injuries, accidents, or losses incurred by the Guest during their stay on the property. The Guest holds Tristate travels, its owner(s), agents and properties harmless of any and all liability related to their stay and usage of the properties.

Disputes and chargebacks: By signing this agreement, the Guest explicitly waives their rights to file disputes and chargebacks without just cause. In the event of any disputes between the Host and the Guest, both parties agree to first attempt to resolve the issue amicably. Should the Guest initiate a chargeback without just cause, the Guest agrees to reimburse the Host for any associated fees or losses incurred as a result.

Termination: The Host reserves the right to terminate this agreement and ask the Guest to vacate the property immediately in the event of any violation of the terms and conditions outlined herein.

By placing a reservation, ALL terms and conditions of this agreement are deemed accepted and receipt of the information herein acknowledged.

Acknowledgment:

By checking the box, both the Host and the Guest acknowledge that they have read and understood the terms and conditions of this agreement and agree to abide by them.
